NEW BRUNSWICK — A state Appeals Court extended the coverage area of drug-free zones a bit Monday when it ruled that a museum that does not keep normal hours falls under the definition of a public building.

Drug dealers caught selling within 500 feet of a public building — as well as public housing and parks — see the severity of charges rise.

The same holds for those caught selling drugs within 1,000 feet of a school.

The case in question concerned the New Brunswick Fire Museum, a museum on the corner of Remsen Avenue and Suydam Street open only upon appointment.

Jessie D. Chambers, 30, was arrested and charged with cocaine possession and distribution near the museum on Aug. 8, 2003.

City police officer Michael Yurkovic, detective Michael Sutton and Lt. Paul Schuster were patrolling the Remsen Avenue area of the city in an unmarked minivan shortly after midnight when they saw Chambers sell drugs to another man.

Because he was within 500 feet of the fire museum, Chambers was charged with a second-degree offense and other charges.

He was convicted in November 2004 and sentenced to six years in prison. He is eligible for parole in about a month.


Drug-free zones disproportionately fall in urban areas, Rosenthal said, making drug dealers there pay a higher penalty than suburban or rural drug dealers.

The New Jersey Commission to Review Criminal Sentencing released a report in 2005 calling for an overhaul of the laws concerning drug-free zones, regarding them unfair and ineffective.

The commission recently noted that blacks and Hispanics account for 96 percent of people convicted and incarcerated for a drug-free zone offense in New Jersey.
