ATLANTA, Georgia (AP) -- The Supreme Court of Georgia ordered Friday that Genarlow Wilson be released from prison, ruling that his sentence for a teen sex conviction was cruel and unusual punishment.

The decision was split 4-3.

Wilson had been sentenced to 10 years in prison after being convicted in 2005 of having oral sex with a consenting 15-year-old girl when he was 17.

He already has served two years in prison.

The case revolves around a New Year's Eve party outside Atlanta in 2003, when Wilson engaged in the sex act with the girl.

Under a now-changed Georgia law, Wilson was convicted of felony aggravated child molestation. Wilson was acquitted on a second charge of raping a 17-year-old girl at the party -- who prosecutors maintained was too intoxicated to consent.

The 10-year sentence was mandatory under the law.

Partly as a result of Wilson's conviction, state legislators changed the law to make such consensual conduct between minors a misdemeanor, rather than a felony. But that change wasn't made retroactive, so it did not affect Wilson.

Wilson's attorneys had been spurred earlier this year by a lower court victory. A Monroe County Superior Court judge ruled that Wilson's punishment was cruel and unusual and voided it on constitutional grounds.

The judge reduced the sentence to one year and said Wilson should not be put on Georgia's sex offender registry, as the old law required.

Wilson's jubilant attorneys hoped the ruling would free him from state prison. But shortly after it was handed down, Georgia Attorney General Thurbert Baker announced he would appeal the decision, a move that kept Wilson behind bars.

Wilson's plight drew national attention and pleas for his release, including from former President Jimmy Carter, a former Georgia governor, and even some of the jurors who convicted him.

Legislation that would make the change in Georgia's child molestation law retroactive in order to free Wilson failed to win approval earlier this year.

i like Farrakhan's approach to the hip hop community, it is a much more beneficial tactic than those being used by other leaders. it’s beneficial for the community because his message is true, especially related to women and girls. but also because it’s enough leaders willing to wash their hands of and point fingers at the community.

there's a whole generation of young folks today who's way of life involves exploiting others and/or putting a price tag on themselves under the guise of empowerment and hustlin'.

they don't even know that life is not just automatically like that. it's not automatic to hoe...or pimp. and that shit is outta hand now fa real.

and i personally believe that it goes back to all those other discussions we've had on materialism and artists and its/their influence on the community, and of course beyond.

i don't even like Farrakhan all like that but i respect him on a certain level. and i feel like he has enough influence to inspire people. he had the potential to do a great deal of good but every man has a private agenda behind a public mission.

i’m definitely not convinced that any man can behold great power and not be eaten alive by it.

ATLANTA - Georgia’s Supreme Court on Friday ordered the release of a young man who has been imprisoned for more than two years for having consensual oral sex with another teenager.

The court ruled 4-3 that Genarlow Wilson’s 10-year sentence was cruel and unusual punishment.

Wilson, 21, was convicted of aggravated child molestation following a 2003 New Year’s Eve party at a Douglas County hotel room where he was videotaped having oral sex with a 15-year-old girl. He was 17 at the time.

Wilson was acquitted of raping another 17-year-old girl at the party.

The 1995 law Wilson violated was changed in 2006 to make oral sex between teens close in age a misdemeanor, similar to the law regarding teen sexual intercourse. But the state Supreme Court later upheld a lower court’s ruling which said that the 2006 law could not be applied retroactively.

Chief Justice Leah Ward Sears wrote in the majority opinion that the changes in the law “represent a seismic shift in the legislature’s view of the gravity of oral sex between two willing teenage participants.”

Sears wrote that the severe punishment makes “no measurable contribution to acceptable goals of punishment” and that Wilson’s crime did not rise to the “level of adults who prey on children.”

‘Grave miscarriage of justice’
The state Supreme Court had turned down Wilson’s appeal of his conviction and sentence, but the justices agreed to hear the state’s appeal of a Monroe County judge’s decision to reduce Wilson’s sentence to 12 months and free him. That judge had called the 10-year sentence a “grave miscarriage of justice.”

Dissenting justices wrote that the state Legislature expressly stated that the 2006 change in the law was not intended to affect any crime prior to that date.

They said Wilson’s sentence could not be cruel and unusual because the state Legislature decided that Wilson could not benefit from subsequent laws reducing the severity of the crime from a felony to a misdemeanor.

They called the decision an “unprecedented disregard for the General Assembly’s constitutional authority.”

A spokeswoman for Wilson’s lawyer said his legal team received no advance notice of the decision.

no offense but i don't believe in man-made religious teachings and writings to that degree. i don't take all that literally. so i am can't spend my time reading all of that. but i understand your point and even respect it to an extent. we just have 2 different perspectives.

i basically co-sign 518p. one's race is not a biblical curse, it's an adaptation as a part of the evolution process.

the original man was from Africa and the population developed and spread from there, adapting to a variety of environmental factors overtime.

however current notions of race and racism are a social construction, meaning man-made, and actually there is no biological basis for race at all. the emphasis we place on them in America is totally out of context with reality.

now altho i wasn't going to acknowledge the big gray elephant in the room...

But of course, the Cavs are one injury away, to the King, from losing 60 games. How scary would that be? If the Cavs had a top 5 pick next year. That kid Mayo would be too raw playing with King James. Hansbrough too, but yeah those 4 in the east are my predictions.

The Bulls are one of those teams that every year could be the one where they go from being 'almost there' to there. @Mush, yeah I think once they all get healthy they'll be O.K. and if Shaq is at 100% they can beat anyone. The only thing is he hasn't been at 100% since oh, 2003. Lol. I used to get bootleg shit all the time, but I stepped my movie stealing game up a little bit. Now, it's all about Netflix and a DVD burner. Order the movie, burn it, send the original back, and you got yourself a DVD quality movie. As far as seeing it before it comes out, I got a lot of boys who somehow get high quality shit the day after it comes out in the theatres. I dont know why, but I know if the movie comes out on friday, most of the time, I can be watchin it at my house Friday night, Saturday at the latest, and it's pretty much VHS quality.

Mérida, October 25, 2007 (venezuelanalysis.com [1])- Responding to US President George W. Bush's threats towards Cuba on Wednesday, Venezuelan authorities warned yesterday that "Cuba is not alone." The US president called on the international community to prepare for a "transition" in Cuba and vowed to maintain the embargo of the island. Both Venezuelan and Cuban authorities rejected the statements, labeling them "imperialist aggression."
"He spoke like an imperialist and a colonialist," said Venezuelan parliamentarian Saul Ortega about Bush's statements. Ortega assured that the reaction to these threats will be increased unity among the people of Latin America. "In response we have to close ranks in defense of the principles of sovereignty and self-determination," he said.
Vice-foreign minister Rodolfo Sanz assured that the United States was making a mistake with their statements towards Cuba and maintained that the "times have changed."
"We aren't going to sit here with our arms crossed before some diabolic adventure," he said. Sanz assured that the Cuban people can count on support from nations like Venezuela, Bolivia, and Nicaragua, among others, stating that "Cuba is not alone."
President Bush made the comments in a speech on Wednesday at the US State Department in Washington. In the presence of Cuban dissidents and their families, the president vowed to continue the 45-year economic embargo against the country and asked the "international community" to support a "democratic movement" in the country.
"Now is the time for the world to put aside its differences and prepare for Cuba's transition to a future of freedom and progress and promise," he said.
In addition, he proposed the establishment of a "Freedom Fund" to help facilitate change on the island, and said his administration would be asking other countries to contribute. He also called on other countries to support Cuban dissidents inside the country and made a clear effort to rally anti-Castro sentiment.
"To ordinary Cubans who are listening: You have the power to shape your destiny," he said. "You can bring about a future where your leaders answer to you."
To the Cuban military Bush said, "Will you defend a disgraced and dying order by using force against your own people?"
Cuban Foreign Minister Perez Roque condemned the statement, calling it "an invocation to violence to bring down the Cuban revolution," and demanded that Washington stop intervening in the internal affairs of the country.
"The United States must stop obnoxiously interfering in the internal affairs of Cuba, they must stop building an opposition against Cuba, and they must stop financing mercenaries," said the Cuban minister in a live broadcast on Wednesday.
After Bush's speech on Wednesday, Caleb McCarry, the Bush Administration's 'Cuba Transition Coordinator,' accused Venezuela of supporting the communist system in Cuba, and asked all countries on the continent to unite in support of a "transition" in Cuba.
"The support of the Venezuelan government for the Cuban government has the purpose of continuing the communist system in Cuba," he said. "It is important that all the countries on the continent support the Cubans in their own process of transition to democracy."
But Venezuelan government officials rejected the declarations from Washington, and showed their solidarity with the Cuban Revolution. Governor of the state of Anzoategui Tarek William Saab considered the statements a declaration of war.
"As revolutionaries, brothers, and friends of the Cuban Revolution, we reject these statements from a decadent president who will go out the back door of history against a dignified country like the Republic of Cuba," he said.
Venezuelan Parliamentarian Saul Ortega assured that Latin America would continue to resist US "imperialism."
"It is against this that the popular struggles of Latin America and the Caribbean are fighting, to break away from being the backyard of the empire's big multinationals," he said.
