(AllHipHop News) 2 Milly is suing Epic Games over his dance "Milly Rock" for the alleged misappropriation, sale and use of the dance in the popular game "Fortnite."
The Brooklyn rapper formally filed the lawsuit in California court Wednesday.
The Milly Rock has endured since 2014 as a music video by 2 Milly as well as a dance with the same name. Epic allegedly took the "Milly Rock" dance and called it the "Swipe It" on "Fortnite's" Season 5.
2 Milly's legal team talked to Variety and gave the reasoning behind their legal maneuver.
"This isn't the first time that Epic Games has brazenly misappropriated the likeness of African-American talent. Our client Lenwood 'Skip' Hamilton is pursuing similar claims against Epic for use of his likeness in the popular 'Cole Train' character in the 'Gears of War' video game franchise. pic cannot be allowed to continue to take what does not belong to it," said David L. Hecht, an attorney at Pierce Bainbridge.
To date, "Fortnite" makes millions off these dance emotes and other content, but never attempted to pay 2 Milly. the rapper said. "They never even asked for my permission. I am thrilled to have David Hecht and his team at Pierce Bainbridge representing me to help right this wrong," he said.
Donald Faison, Chance The Rapper and others have also been critical of "Fortnite" and Epic for similar moves.
