(AllHipHop News) Jussie Smollett’s name stays in some controversy.
Back in January, the Chicago actor and singer was allegedly assaulted in a homophobic attack by two masked men.
After much back and forth with the prosecutors, police alleged Jussie paid his two attackers to stage the assault for publicity and a pay raise on the TV show "Empire."
Jussie was indicted on 16 counts along with disorderly conduct and filing a false police report — all of which were dropped.
In May, he walked away free from authorities.
Now, his lawyers are coming in hot to slam a judge’s decision to assign a special prosecutor to re-investigate the dropped criminal case.
At the end of June, Cook County Judge Michael Toomin re-opened the case by appointing a special prosecutor who had the power to bring new criminal charges against Jussie.
The "Empire" star’s attorneys Tina Glandian and Mark J. Geragos come to Jussie’s defense to blast Toomin.
The motion reads: “This case has been a travesty of justice and an unprecedented deprivation of Mr. Smollett’s constitutional rights, including the presumption of innocence and right to a fair trial. Not only have the media and the public failed to critically look at the evidence (and lack thereof) against Mr. Smollett, but now, the court has accepted false media reports to presume Mr. Smollett guilty of charges which he pled not guilty to and which were dismissed against him.”
