Jay Z’s Tidal Responds To $5 Million Lawsuit Over Royalties


(AllHipHop News) After having a fairly successful run over the last month with exclusive releases by Beyoncé, Rihanna, and Kanye West, Tidal was once again hit with bad headlines. Yesh Music filed a $5 million lawsuit against the Shawn “Jay Z” Carter led streaming platform alleging John Emanuele,​ of the band The American Dollar, is owed royalty payments from Tidal.

The suit names Jay Z’s S. Carter Enterprises, “Black Panther Bidco,” and Aspiro (Tidal is a subsidiary of Project Panther Bidco, which is owned by Carter). Court documents filed by Yesh Music read in part, “Ironically, when Defendant CARTER purchased the TIDAL Music Service in 2015, it claimed it would be the first streaming service to pay the artists. Different owner, same game.”

Tidal responded to the lawsuit in a statement to Fader:

TIDAL is up to date on all royalties for the rights to the music stated in Yesh Music, LLC and John Emanuele’s claim and they are misinformed as to who, if anyone, owes royalty payments to them. As Yesh Music, LLC admits in their claim, TIDAL has the rights to the Master Recordings through its distributor Tunecore and have paid Tunecore in full for such exploitations. Their dispute appears to be over the mechanical licenses, which we are also up to date on payments via Harry Fox Agency our administrator of mechanical royalties.

The main compositions in question were release by The American Dollar and their entire catalogue streamed fewer than 13,000 times on TIDAL and its predecessor over the past year. We have now removed all music associated with Yesh Music, LLC and John Emanuele from the service. This is the first we have heard of this dispute and Yesh Music, LLC should be engaging Harry Fox Agency if they believe they are owed the royalties claimed. They especially should not be naming S Carter Enterprises, LLC, which has nothing to do with Tidal. This claim serves as nothing other than a perfect example of why America needs Tort reform.

        they’re not entitled to their royalties if they sold the rights.. I think 50 sold some of his rights (obviously he still has some rights as he receives royalty payments, but I feel like he doesn’t own them all?), and Montell Jordan (for example) sold ALL of his.. when he went broke.. Yes, even the “This is How We Do It”.. I don’t care how broke I was going, I’d have held on to that MF.. lol

  • This smells like an Apple/ other competitors smear campaign. They mad after all of Kanye’s antics (which by the way is looking more and more like a serious marketing campaign run ghost style like The Wizard of Oz thru Jay Z) they can’t get some of that Kanye revenue. Jay Z is a serious beast on the biz side.

    Really? They’re suing Tidal when when Spotify & Pandora pay something like $00.000001 or barely a thousandth of one cent per play (not joking)? and itunes reportedly ain’t much better?

    Try again son. And I’m surprised at non-haterish the comments are towards Jay-Z, props people. This lawsuit shows the liabilities of a celeb acting as head of a company that he only owns minority shares in. Yes he’s the figurehead but not majority shareholder or CEO.

    Still props to Jay and Tidal for paying better than the rest.
