being a felon in possession of a firearm. Pat was charged in January of 2001,

when Memphis police stopped him for speeding. According to the police, they

found two revolvers in his SUV. At the time he was on parole for aggravated

robbery.

Pat was tried once on these charges in January

but a Memphis federal court jury deadlocked and the second trial was moved to
