Hip-Hop mogul Jay-Z and Iconix Brand Group, owner of Rocawear Clothing, are being sued in federal court on copyright infringement charges.

The case was filed last Thursday (September 18) in Georgia Northern District Court by I Will Not Lose, LLC, a company claiming that Iconix Brand Group and Jay-Z, real name Shawn Carter, adopted the exact same “I Will Not Lose” trademark.

Last March, Jay-Z sold the rights for Rocawear to Iconix Brand Group for $204 million.

Despite this, Carter is also named in the suit as it is believed by the plaintiff that he continues to oversee the product development, licensing, and marketing of Rocawear.

Last year, Rocawear launched an international “I Will Not Lose Campaign,” (www.iwillnotlose.org) where stars such as Chris Brown and Ciara gave accounts of how they overcame personal challenges before reciting the trademarked phrase “I Will Not Lose.”

I Will Not Lose, LLC (www.iwillnotlose.net) CEO Reggie Tucker alleges in the lawsuit that his company trademarked the brand first and were subsequently ignored throughout 2007 after attempts were made to settle the matter out of court.

The plaintiff is seeking an undisclosed amount of damages for the dilution of their trademark.

At press time calls to attorneys representing I Will Not Lose, LLC were not returned and Jay-Z could not be reached for comment.

You become a target for every thirsty little fuck out there...

According to my research and talking to people that have gone through this, even if this group trademarked the phrase first Jay still can continue using it if he can prove he was using the phrase before their trademark.

And we all know Jay has been saying it for close to ten years. The plaintiffs could prevent possibly prevent Jay from advertising that phrase in the state of Georgia but I doubt they'll get anything else they're asking for.

You know what? No idea is original under the sun. If i was jay i would say..."i came up with that. its a coincidence they have the same name. if they can pay their lawyers lets take it to court. cause i can. plus if those people are from another state......they are only gonna get rewarded for profits made in their state. i dont blame them. thats happened to alot of us local arrtists. its worth a try. maybe jay did steal the slogan. good for you. but stop coming up with good ideas and settling out of court. if u good then "put yourself on in" (swagga like us) and stop bitching. you are nopbody till you are somebody. roll with the punches and step your game up. Its you against the world dawg. be somebody cuz this industry is grimey and your shit will be taken. Pete Rock made juicy and diddy stole it. he got bread and made a name for himself. who is the jury gone believe? a smuck or a star? correct me if im wrong IMO!!!!

on to the issue at hand,

i agree that they may have copyright the phrase after jay said it in a song or whatever.

and honestly what is "i will not lose LLC' what is it some real estate thing? either way its a phrase thats normal nowadays like saying "whats the dealy yo" in '97. busta first started saying that but if i addressed my boy like that, would busta sue me for publishing??????  it doesnt work that way.

finally, this was a solidly well written story. i only get on y'all when your stories look like they are written by a 6 year old ahh. but i respect good work  and this was a good piece of journalism.
