DMX failed to make an obligatory court date on Tuesday, where the rapper was expected to answer to charges related to driving with a suspended license.

DMX traveled from Europe to New York to appear in a Bronx courtroom, but the rapper’s lawyer said a possible case of food poisoning might have prevented the him from making the date.

Judge George Villegas accepted the Yonkers native’s excuse, but told the court that an arrest warrant would be issued if the Yonkers native didn’t appear in court by Monday. The prosecutors wanted the warrant to be given out immediately, according to the New York Post.

On April 15, the rapper’s 2005 Dodge Magnum allegedly hit a car that, in turn, hit an unmarked police vehicle. The prosecution charges that DMX wasn’t supposed to be driving, as his license was suspended. Neither DMX nor his wife or children were injured in the collision, but the two officers were hurt.
