Jay Z Facing Lawsuit For Using The Word "Oh" On "Run This Town"

(AllHipHop News) Hip Hop superstar Jay Z, WB Music Corp, Warner-Tamerlane Publishing, Roc Nation, Atlantic and Roc-A-Fella Records are facing a copyright lawsuit for sampling the word “oh” on Jay’s#### record “Run This Town.”

The TufAmerica record label claims Hov illegally took the single syllable word from the track “Hook & Sling –  Part 1” by Eddie Bo.

Jay Z is fighting back though. According to TechDirt.com, the Brooklyn emcee filed a motion to dismiss the lawsuit earlier this month. Jay’s court papers read in part:

Plaintiffs entire, misguided copyright infringement lawsuit is based on an alleged “sample” of the most fleeting one-syllable word – “oh” – in defendants’ sound recording entitled, “Run This Town” performed by the artist Jay-Z. Plaintiff alleges that this single-word sample is derived from Plaintiffs musical composition entitled “Hook & Sling Part 1”  and the sound recording thereof.

Importantly, Plaintiff does not allege that any musical element of Plaintiffs Works was copied – only the spoken word “oh,” which appears just once in the introduction to Plaintiff’s Works at approximately the 3-second mark, lasts for a fraction of a second in Plaintiffs Recording and is not repeated.

Plaintiff apparently believes that it has a monopoly on the use of the word “oh” and that it can stop others from using this word in recorded form. Well-established copyright jurisprudence should allow this Court to disabuse Plaintiff of that notion. First, it is black letter law that words and short phrases are simply not protectable under the Copyright Act. Thus, Plaintiff cannot state a claim based on the alleged infringement of a generic lyric such as, “oh,” or the sound recording thereof, and Plaintiffs claims should be dismissed as a matter of law.

TufAmerica’s suit was filed in November of 2013. The company acquired the rights to “Hook & Sling” in 1996. “Run This Town” was released in 2009.

According to The Guardian, the label previously sued Kanye West over the same song. The track is apparently sampled on Ye’s “Lost in the World” off My Beautiful Dark Twisted Fantasy.

Hip-Hop Rumors: Trina Drops Track Dissing Khloe Kardashian!

French and Khloe are supposedly on a break and for a minute and the world has probably been wondering how Miss Trina has been feeling about the whole thing.

Before hooking up with one of the Kardashians, French and Trina were living together in New Jersey, seems like his new relationship probably came as a surprise. The Diamond Princess has finally spoken and TMZ reports that she’s holding nothing back.

“Rapper Trina is on the attack … BLASTING her ex French Montana and Khloe Kardashian for screwing behind her back — and TMZ obtained a snippet of her new anger filled track about the affair.

Trina never mentions either French or Khloe by name in the new song called “F*** Love” … but sources close to the rapper tell us their tryst last year was definitely the track’s inspiration.

Trina doesn’t pull punches … insinuating French tried to play her for a fool — and referring to Khloe with the line, “You can keep that b####!”

As we previously reported … Trina and French were living together in New Jersey when Khloe came on the scene. Sources close to the couple said Trina was devastated by the break-up.”

Now Kim Kardashian and Trina are friends, wonder where that stands as of now…

Thurz – "21"

Los Angeles based emcee Thurz released the party jam “21” off the Designer EP, to be released via Red Bull Sound Select on 11/4. The track celebrates the right of passage that is turning 21 and is the perfect end of summer track. “21”, produced by Marlon Travis Barrow, is the second song Thurz has released off the forthcoming EP, following “Perfect Words”, which features Kelsey Bulkin and was produced by Rahki.

Hip-Hop Rumors: Could TDE Do Detox With Dr. Dre?

This is an interesting one indeed. Last night, Ab Soul was at the CRWN event in New York City with Elliott Wilson and something popped out of their conversation. Ab Soul seemingly wants to do the unthinkable. He suggested that he wanted to try to get the whole TDE taking over the coveted Detox project on for Dr. Dre and put it out. As it was explained to me, this isn’t something that’s actually on the table, but just something he wants to do. What do you think? It took me a minute to process it, but I think its possible this could work for the modern era…even SZA. Update Detox! U.D.! U.D.! U.D.!

According to TMZ, the singer’s rep has confirmed Alsina is being treated for seizures. The rep added doctors did not find any drugs in Alsina’s system besides marijuana, and the cause of his on-stage collapse was likely due to exhaustion and dehydration.

Ne-Yo on The Compound Foundation’s Mission:

“Circumstance should never stand in the way of a child’s dream. Being a foster kid, you kind of get this red stamp of disapproval before you get an opportunity to prove and show who you are, and I don’t feel like that’s fair. That’s why The Compound Foundation was founded; to keep these kids inspired, to keep these kids educated of the opportunities that are out there for them, and to make sure that these kids understand that where you come from, and where you end up don’t have anything to do with each other.”

Check out AHH’s exclusive video with guests & honorees of the night below, and head over to The Compound Foundation to learn more about their work in the community.

“[Ross] was high,” said Wale. “He gonna come in that joint smelling like a tree trunk. But that’s how he is though. He was just like, ‘Man, what? We ain’t talking bout this right now.’”

The DMV representative then expressed how it was unfortunate the two rappers got into that public argument two days before Meek went to jail. Wale says he has not had the chance to speak with Meek since he has been incarcerated, but they were able to connect through other people.

“I actually did a song with his cousin, his best friend,” revealed Wale. “And I even poked fun at Meek and me arguing on the record. It’s all good. I think he comes home in late September, so it’s all good on all sides.”

Eric Bellinger Ft. The Game “Awkward”

Eric Bellinger and The Game have teamed up once again, this time for Bellinger’s upcoming mixtape, Choose Up Season, for the track “Awkward.” The mixtape is slated to be released on October 1st. Additionally, a trailer debut for the mixtape happened today.

Bellinger stated, “The single life in LA is wild. And the ‘CHOOSE UP’ can get very real. After you choose up, it’s time to leave the club and get your car from ‘VALET’ before continuing the turn up with a ‘HOUSE PARTY’ at the crib. If things go right, you know she’ll pulling out the ‘NIGHT BAG’ and talking to ‘THE PILLOW’ while the two of you become ‘NIGHT OWLS.’ However, it’s usually agreed upon in the beginning that the two of you will ‘NEVER BE TOGETHER’ and that things are just ‘CASUAL’ until one of them catches feelings and things instantly get ‘AWKWARD.”

On the track, Bellinger asks for things to go back to the way they were the day before him and his girl became involved. He sings, “This sh*t is just awkward.” Bellinger sings about the awkwardness that follows a break up where the other keeps in contact with your friends, family etc. The Game raps “Instead of you acting crazy I suggest you see other men.” Cuffing Season is on the way!

Childish Gambino Doubles Down On His Comments That He's Better Than Drake

(AllHipHop News) Say what you want about Childish Gambino, but you can’t say the actor/rapper lacks confidence. After calling out Drake (as well as Kendrick Lamar & Schoolboy Q) at a concert in Australia earlier this summer, the “3005” creator repeated his belief that he is a superior emcee to Drizzy.

[ALSO READ: Childish Gambino Calls Out Drake, Kendrick Lamar & Schoolboy Q (VIDEO)]

During a recent presentation with Hot 97’s Peter Rosenberg in Los Angeles, Gambino was asked by a member of the audience about Drake. The former star of Community praised the Toronto rhymer, but he did not fall back on his previous statements.

“I don’t hate Drake at all. I really like Drake, if not for no other reason than he makes me better. He really does, for real,” stated Gambino.

The entertainer also known as Donald Glover added, “I think he’s a really good writer and rapper. Right now, I definitely think I’m better than him, but only because I’m working harder than him right now. If he came in right now like, ‘Let’s rap,’ I’d be like, ‘Oh, I’mma kill you.’ But like right now. Maybe he’s got something up his sleeve.”

Gambino performed for the crowd at the Grammy Museum’s Clive Davis Theater as well. The audience got to hear the first live performance of the Atlanta native’s self-described “Michael Jackson-esque” single “Sober.”
