Report: New York City Seeking Federal Court Approval To Mass Arrest Protesters

(AllHipHop News) In 2011, the New York Police Department arrested nearly 700 Occupy Wall Street protesters on the Brooklyn Bridge. The protesters sued the city on the grounds that police led them onto the bridge and then arrested them without adequate warning.

A federal court ruled that Occupy’s lawsuit could proceed. Judge Jed Rakoff agreed that by the cops walking in front of the protesters it gave “an implicit invitation to follow.” The ruling also stated the protesters’ constitutional rights were violated and the police did not have cause to arrest them. A three-judge panel of the U.S. Court of Appeals upheld the ruling in August.

The U.S. Court of Appeals for the Second Circuit has now agreed to the city’s request for the case to be heard at an en banc hearing before all 22 judges. This could effectively prevent the case from going to trial.

This could have a direct impact on the current protests that have been taking place in New York. NYPD Commissioner Bill Bratton stated there would not be any mass arrests of the “Black Lives Matter” protesters. Bratton explained that decision recently by saying, “When you lock up five or six hundred people all at the same time, you don’t have what the courts require to successfully prosecute.”

Despite that statement, Mayor Bill de Blasio’s administration is still attempting to have the Occupy Wall Street case thrown out. Legal experts on the side of the protesters see that move as seeking approval for the NYPD to have the power to make arrests in mass.

“Mayor de Blasio, even though he says that he supports peaceful protest with those rulings that held the police in check, now he’s trying to unravel them,” said the legal director for the Partnership for Civil Justice Fund Carl Messineo.

PCJF legal director Verheyden-Hilliard added, “That is what the courts were ruling on. Simply the fact that police cannot mass arrest people without notice and opportunity to comply with an order; notably as here they were led and escorted out onto the bridge. So by seeking to overturn that order New York City is seeking the power to conduct sweeping mass arrests without people having any clue that they’ve done anything wrong and are going to be arrested, and no opportunity to comply with any order that they should disperse.”

The protester’s side is wary about the upcoming hearing, but New York City representatives are looking forward to presenting their arguments before the Second Circuit.

“We are pleased that the full court has decided to hear the case,” said a New York Law Department spokesperson.

T.I. Responds To Q-Tip's Hip Hop History Lesson For Iggy Azalea

(AllHipHop News) Hip Hop legend Q-Tip initiated an important conversation over the weekend when the A Tribe Called Quest member sent a series of tweets to Iggy Azalea about the history of Hip Hop. Iggy’s mentor T.I. decided to respond to Q-Tip’s comments via Twitter as well. The Hustle Gang leader also offered support to his artist Azalea.

Legendary Producer Larry Smith Dies

Legendary producer Larry Smith has passed on after crafting hits for the likes of Run DMC, Whodini and Kurtis Blow during Hip-Hop’s earliest phase.

Smith was a Hip-Hop musician without peer, who used live instruments on rap songs.

Run of Run DMC immortalized Smith on the group’s#### record “Sucker MC’s” when he said, “Larry put me inside his Cadillac /The chauffeur drove off and we never came back.”

Smith had been ailing in recent years due to a stroke and succumbed on Friday December 19.

DMC of Run DMC fame paid his respects on Twitter. “Rest In Beats larry Smith Music In Your Heart hip Hop Was Your Gift to The World! No one does it better!”

At a recent concert stop in Brooklyn, Run paid his own respects.

“My man Larry Smith, he produced these records. It’s sad but fitting he passes away on the day I return to a big stage like this… I love you Larry, I hope you’re watching from Heaven and I’m making you proud,” Run said at the Barclays Center in downtown Brooklyn.

Will The U.S. Make A Play For Assata Shakur?

If you have a conscious bone in your body, you know that Assata Shakur has been in Cuba for the past 40 years in political asylum. As the United States and Cuba work towards better diplomatic relations, a lot of folks like myself are wondering what will become of the 67 year-old revolutionary.

Hip-Hop intellect Micky Factz weighed in on Facebook, “While ya’ll clamor about Bobby Shmurda, The USA & Cuba are in talks for diplomatic relations… Meaning the capture of Assata Shakur… Whom the FBI has as the number 1 female terrorist in the world…because she “allegedly” murdered a state trooper. She escaped prison and has been in cuba for 40 years. Shmoney dance to that.”

In 2013, I penned a piece called called, “Hip-hop’s infatuation with Assata Shakur: It’s complicated,” where I talked about rap music’s love of the political icon. On the other side, the police and their supporters in New Jersey have wanted Assata’s head forever and have gone so far as to make her the first woman added to their list of living terrorists. And, then put a price on her head for $2 million. A member of the Black Liberation Army, Shakur was convicted in 1977 of the 1973 for the murder of state trooper Werner Foerster. The details of the case have been highly debated to say the least and her supporters maintain she is the victim of a corrupt justice system.

Certainly, Assata’s case take on a new context if we look at the present times and how justice has played out recently with video recording, technology and highly questionable policing. Then bundle that with, COINTELPRO, a national legacy of police brutality and abuse of power, and the notion that those police tactics were infinitely more sinister in the 1960’s. We as “a people” need to collectively rethink – not demonize – Assata. But, demonizing persists as the American way, whether you’re a dead young Black man or an elderly living Black woman.

It has been proven several times over, based on forensic evidence, that she was shot twice by police with her hands up. Sound familiar? It actually sounds like Assata deserves reexamination indeed.  We live in times where there is violence perpetrated against who speak out. New York Police have even petitioned for permission to mass arrest protestors without warning.

All of this on President Obama’s watch.

LL Cool J And Canibus End Long-Running Feud

Once upon a time, LL Cool J and Canibus waged one of the most storied, epic beef in Hip-Hop history.

Last night that beef came to an end in Brooklyn.

The two men put their differences aside at the “Christmas in Brooklyn” concert with LL Cool J and Run DMC Friday night.

The 17-year beef came to a close with the two men hugging it out and performed the LL Cool J hit “4,3,2,1.”

From the stage, LL said, “Had a lot of beefs in my life but sometimes we gotta be bigger than that, sometimes you got to take things to the next level, sometimes we gotta flip the script.”
“Yo, Canibus…I love you, boy” LL said. “Your career is starting again, baby.”

Other prominent figures in the Hip Hop community have begun sharing their thoughts on the matter as well. One of those artists is Q-Tip of A Tribe Called Quest.

Adult Swim's "Black Dynamite" Musical Will Feature Voiceovers from Erykah Badu and Tyler, The Creator

Black Dynamite has always been a show that featured a plethora of dope artists and comedians to voiceover different characters. Recently, it was announced that Tyler the Creator and Erykah Badu would be voice actors in the first “Black Dynamite” musical. The episode is set to air on Adult Swim January 10th titled “Wizard of Watts.” According to XXL, the episode will also touch on racial tension and protests in our society by illustrating racial tension in the community of Watts, California. This isn’t the first time Tyler Creator has made an appearance on Cartoon Network. The rapper appeared on a rap episode of Regular Show. This will also be Badu’s second appearance on the popular series.

Maybe the revolution will be televised. We’ll keep you updated.
