@ Boss Up, I think it goes like this: If you get pulled over with contraband in your whip, and it's in the center compartment, you get the charge, because its not on anybody else or "in reach" of any other passengers, and its your whip.  The cops will try the "We're taking everyone to jail if no1 fesses up"; but that would last for about 4 hours until everyones lawyer got to the precint & then it finally gets pinned on the driver.  
Plus I think they saw P making "suspicious movements".

Yeah dude is dumb as a bitch for being a semi-high profile nigga and ridin wit a dirty pistol. Real niggas wit money know that if you gotta ride like dat, at least have a nigga in da car dat'll take da charge.

It is standard procedure to lock everyone up when there is contraband in an area of suspects. Let's say they only lock one person up, but three people are in the area of the contraband. Well any half-way decent lawyer will use that as reasonable doubt. They will say that the contraband may not have belonged to the suspect arrested.

Of course the cops will make it like it could only have belonged to that person but really it's not enough. Especially if the lawyer can play the race card. If you're the DA you shoot for a "no jail" deal right away, but probation still counts as a conviction (that is how they trick cats). That is a tell-tell sign that the state has no case.

Now if the police lie and say that the only person present was the person arrested then they can make it tougher to raise the reasonable doubt. Most of the time the cops will not lie for fear the other people they did not arrest will act as witnesses. Even if a jury convicts on some shit like that you can win on appeal because technically unless they have fingerprints or something incriminating who is it to say that it belonged to the only suspect arrested (even if they find prints). They had P on this one, it was his vehicle, and they dismissed the charges against the Alchemist.

Now if they would have let the Alchemist go and only locked P up he would have beat it. In Jada's case there were other people in the car, and only Jada got arrested for it and they found no fingerprint evidence (tons of reasonable doubt) those cops were supposed to lock everybody in that car and then dismiss the charges against the ones they didn't want. The police have to be perfect always remember that.
